These Terms are the agreement between you and Lumen & Gesso (“we,” “our,” the “studio”) when you use lumengesso.com or place a custom pet-portrait commission. By using the site or placing an order, you accept these Terms.
Lumen & Gesso is a small studio in the United States offering custom pet portraits. You upload photos of your pet, pick a style and finish, and we render and prepare a portrait that we print and ship to you. Every commission goes through a proof step where you can request revisions before anything is printed.
To be transparent: portraits are rendered using AI image-generation tools (such as Google Gemini and OpenAI), then reviewed and refined by the studio before printing. This is part of how a small studio can produce gallery-quality work affordably and quickly.
You sign in to track an order or place a new one using a magic link sent to your email address. You’re responsible for keeping the email account secure. You must be at least 18 to place a commission and provide payment.
You keep ownership of the photos you upload. By submitting them, you confirm that:
You grant us a limited, worldwide, royalty-free license to use, copy, modify, and process your photos solely to render, proof, produce, and ship your commission, including sharing the photo with the third-party services listed in our Privacy Policy (image-generation providers, the print partner, hosting, etc.). This license ends a reasonable time after your order is complete or when you ask us to delete the photos, whichever comes first.
We will not use your pet photo or finished portrait in our public gallery, social media, or marketing without asking you first.
When your final portrait is approved and we deliver it to you, you own a personal-use copy of that portrait — you can hang it, gift it, photograph it, and share images of it on your personal social media. The studio retains ownership of its underlying styles, templates, prompts, brand, and any non-pet visual elements we use to produce the work.
You may not resell, license, or commercially distribute the finished portrait or reproductions of it without our written permission.
You will receive a digital proof for review and approval before anything is printed. Revisions are included until the proof is right for you. Once you approve the proof, we move it to production.
We do our best to capture your pet’s likeness, but every portrait is a stylized rendering — not a photograph — so we cannot guarantee photographic accuracy. The proof step is when to ask for changes; please use your revision rounds before approving.
Production typically takes a few business days after you approve the proof, then printing and shipping is handled by our fulfillment partner Prodigi. Delivery time depends on your location and the shipping method available at checkout. You’ll receive tracking when your portrait ships.
You’re responsible for ensuring the shipping address is accurate. We’re not responsible for losses or delays caused by an incorrect address, an unattended delivery, or the carrier’s handling.
Refunds and replacements are covered by our Refund policy, which forms part of these Terms.

The website, logo, brand, gallery imagery, prompts, style catalogs, and any content we create are owned by the studio (or licensed to us) and are protected by copyright and trademark law. You may not copy, re-host, or use them outside of viewing the site normally without our written permission.
The site and the commissions are provided “as is.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the site will be uninterrupted, secure, or error-free, or that any rendering will exactly match your expectations.
To the fullest extent allowed by law, the studio is not liable for indirect, incidental, special, or consequential damages, or for any lost profits, revenues, data, or goodwill. Our total liability for any claim arising out of or related to your use of the site or a commission is limited to the amount you paid us in the twelve months before the event giving rise to the claim, or $100, whichever is greater.
You agree to indemnify the studio against any claim brought by a third party arising out of your content (for example, a copyright or privacy claim about a photo you uploaded) or your violation of these Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The federal and state courts located in Manatee County, Florida have exclusive jurisdiction over any dispute that is not resolved informally. You and the studio agree to try to resolve any dispute informally by email first; we ask for at least 30 days’ notice before any formal action.
We may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date at the top of this page and, when warranted, email customers with active orders. Continued use of the site after changes means you accept the updated Terms.
